Before the hearing, the administration faces a Tuesday deadline to respond in writing to Trump’s request, according to the court’s scheduling order.
U.S. District Judge Aileen Cannon, who was nominated to the seat by Trump in 2020, is asking the Justice Department to file a public response and in addition to file records under seal with more details about what was seized from the search as well as a notice that determines the status of the screening of seized materials, including the process of filtering privileged information.
Trump’s response to the Justice Department’s response is expected Wednesday.
The hearing will take place at 1 p.m. ET Thursday at the courthouse in West Palm Beach.
Cannon said at the end of the order that it should not be construed as her final decision on the matter.
On Friday, Trump responded to Cannon’s request to clarify his request for the special master, pointing to some additional legal discussion about case law that he said supported his request.
Cannon had identified several deficiencies in his testimony Monday calling for more oversight.
