The Calgary man who was critically injured in an ambush shooting — which killed his wife — is facing criminal charges, including participating in or contributing to the activities of a criminal organization.

Fouani, 46, and his wife, Nakita Baron, 31, were attacked on a neighbor’s driveway in the Evergreen community on Aug. 18 shortly after 8 a.m. and shot repeatedly in their Bentley, just doors from their home in Everwoods Court SW. Fuani was taken to hospital in a life-threatening condition, where he remains. Baron – who was killed in the ambush – had recently studied at Mount Royal University and was pursuing his dream of becoming a doctor. Police said a man is believed to have approached their car and fired multiple shots into the vehicle before leaving the scene in an SUV, described as a black Mitsubishi Eclipse manufactured between 2017 and 2020.

The suspect was described as approximately 25 to 35 years old, approximately five feet eight inches to six feet and 180 pounds with a medium build, wearing a dark blue hat, dark hooded top, bright orange T-shirt, yellow reflective vest and dark colored pants. The two brothers face three counts: laundering the proceeds of drug trafficking, possession of cash obtained through drug trafficking, and participating in or contributing to the activities of a criminal organization by laundering the proceeds of crime. El-Chammoury faces the first two charges. According to court documents granted bail on June 14, the brothers are prohibited from contacting a group of 23 named people. An Internet check of those identified found articles indicating 10 people with the same names facing serious drug charges in recent years. Fuani was a key witness at an Alberta Securities and Exchange Commission hearing three years ago into allegations of a “pump and dump” scheme in which traders manipulated stock prices.

While the panel found that Cem (Jim) Can and Charles Michael Miller committed fraud in the trading of Bluforest Inc. stock, its panel was unimpressed with Fouani’s testimony. “Fuani was not a credible witness,” the commission’s three-judge panel said in its written decision. “He sought to minimize his involvement in Bluforest, which he claimed was limited to introducing Can to certain people when he and Can were ‘friends’. He testified that he did not know what the respondents were doing and that he did not believe anything illegal or improper was going on,” they said. “In light of his demeanor, evasive and non-responsive answers, and poor memory, we gave very little weight to his testimony unless it was corroborated by credible evidence.” The brothers are scheduled to go to trial in September and October 2023.
